his Privacy Policy is drawn up pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (hereinafter “GDPR”) and provides you with information on the processing of personal data carried out by Aquacloud GmbH through the website aquacloud.it.

WHAT DATA DO WE PROCESS?
The computer systems and software used to operate the website collect certain personal data whose transmission is implicit in the use of Internet communication protocols (e.g., IP addresses or domain names of the computers used by users connecting to the site, URI addresses – Uniform Resource Identifiers – of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the response given by the server – success, error, etc. – and other parameters relating to the user’s operating system and computing environment). Although this information is not collected in order to be associated with identified data subjects, by its nature it could, through processing and association with data held by third parties, allow users to be identified.
As regards the processing of personal data connected to the submission of an application through the “Work with us” or “Contact us” section of the site, your data will be processed on the basis of your job application and/or contact request and will be retained until the expiry of the five-year limitation period set out in Art. 2949 of the Italian Civil Code, running from the termination, for any reason, of the corporate relationship.
PURPOSES, LEGAL BASIS, AND RETENTION PERIODS
1. Website Management
We will process browsing data for:
- technical maintenance of the site;
- establishing liability in the event of alleged cybercrimes against the Site;
- obtaining anonymous statistical information on the use of the site and checking that it is functioning correctly.
The legal basis for this processing is our legitimate interest in ensuring the proper use of the Site and preventing any possible cybercrime. We will retain this data for the periods provided for by the law currently in force.
2. Handling of contact requests
We will process the personal data contained in the contact request for the time strictly necessary to handle that request.
3. Job Application
Your data will be processed on the basis of your job application and will be retained until the expiry of the five-year limitation period set out in Art. 2949 of the Italian Civil Code, running from the termination, for any reason, of the corporate relationship.
PROCESSING METHODS, DATA COMMUNICATION, AND DATA SUBJECT RIGHTS
How will we process your data?
Personal data will be processed both on paper (the documents will then be stored in locked cabinets) and digitally. Only employees and collaborators of the Company who have been specifically authorized may access this data. These persons may carry out consultation, use, processing, comparison and any other appropriate operation, including by automated means, in compliance with the legal provisions necessary to ensure, among other things, the confidentiality and security of the data, as well as its accuracy, updating and relevance to the stated purposes.
To whom will we disclose your data?
All data collected and processed may be disclosed, solely for the purposes specified above, to:
- providers of IT system management services;
- Aquacloud offices.
Beyond the above, personal data is not subject to dissemination.
Where will we process your data?
We will process your data within the European territory and will not transfer it to non-EU countries.
WHAT ARE YOUR RIGHTS?
How can you exercise your rights?
With regard to the personal data provided, you have the right to exercise at any time, in accordance with the GDPR, the rights established therein and listed below:
- Right to withdraw consent (Art. 7(3) GDPR): the right to withdraw the consent given. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal;
- Right of access by the data subject (Art. 15 GDPR): the right to obtain confirmation of whether or not personal data concerning you is being processed, and a copy of it in an intelligible form;
- Right to rectification (Art. 16 GDPR): the right to have inaccurate personal data concerning you rectified;
- Right to erasure (“right to be forgotten”) (Art. 17 GDPR): the right to have your personal data erased;
- Right to restriction of processing (Art. 18 GDPR): the right to obtain restriction of processing, for example where the accuracy of the data is contested or in the case of unlawful processing;
- Right to data portability (Art. 20 GDPR): the right to receive the personal data concerning you that you have provided to the Company in a structured, commonly used and machine-readable format, and the right to transmit such data to another controller without hindrance from the Company, where the processing is based on consent or on a contract and is carried out by automated means;
- Right to object (Art. 21 GDPR): the right to object to the processing of your personal data;
- Right not to be subject to automated decision-making (Art. 22 GDPR): the right not to be subject to a decision based solely on automated processing.
These rights may be exercised in writing by contacting the Controller at the contact details indicated above, and further information about the processing of personal data may be requested at any time. Please also note that the exercise of your rights must not prejudice or infringe the rights and freedoms of others.
The Company undertakes to respond to requests within one (1) month, except for particularly complex requests, for which up to a maximum of three (3) months may be needed. In any case, the Company will explain the reason for the delay within one (1) month of the request.
The outcome of the request will be provided in writing (at the data subject’s request) or in electronic format (and, in this case, free of charge). The Company specifies that a fee may be requested if your requests are manifestly unfounded, excessive or repetitive; in this regard, the Company will keep a record of requests.
In accordance with Art. 19 GDPR, the Company undertakes to inform the recipients to whom the data subject’s personal data has been disclosed of any rectification, erasure or restriction of processing requested by the data subject, where this is possible.

Whom can you contact if we fail to comply?

CHANGES AND UPDATES
Aquacloud GmbH may make changes and/or additions to this notice, including as a consequence of any subsequent amendments and/or additions to the applicable legislation. In such cases, the new version of this notice will be communicated as soon as possible, by means designed to reach all data subjects as quickly as possible.
